YOUR PRIVACY
In order to better serve your needs now and in the future, we may need you to
provide us with certain information, including personally identifiable
information (“PII”). We understand, however, that you may be concerned about
what we will do with such information and we agree that you have a right to know
how we will utilize the PII you provide to us. Therefore, we have adopted the
following Privacy Policy to govern the use and handling of your PII:
I. Applicability.
This Privacy Policy governs our use of the PII you provide to us through the
www.edatatrace.com, www.hyperabstract.com, and www.nydata.com websites (the
“Websites”). It does not govern the manner in which we may use information we
have obtained from any other source, such as information obtained from a public
record or from another person or entity.
II. Information Collection and Use.
Depending upon which of our services you are utilizing, the types of PII that we
may collect through the Websites include:
- Information we receive from you on applications or other forms, including your
name, email address, company name, city, state and telephone number;
- Certain registration information such as user ID and password; and
- Information about your transactions with us, our affiliates, or others.
We may use information that you provide to us, including PII, for any internal
purpose, such as quality control efforts or customer analysis.
Order Fulfillment
Clients may choose to order products electronically from the Websites. Completed
orders are accessible only to the client that placed the order, and require a
valid user ID and password.
Cookies
A cookie is a file stored on your hard drive containing information about you.
We may use cookies to identify you and provide you a more customized browsing
experience while you are on the Websites. For example, if you let us put a
cookie on your hard drive, we may be able to give you access to pages without
requiring you to log in. If you refuse to allow us to place a cookie on your
hard drive, you may not be granted access to the Websites, or you may be
restricted from some pages and services.
The Websites may contain links to other sites that may use cookie technology. We
do not have access to, or control over, these cookies.
Log Files
We may track IP addresses and navigation patterns when we monitor traffic on the
Websites. We use this information to improve the structure, content and general
usability of the Websites. Such information may be linked to PII for billing
purposes, or to provide service and support to our users.
Other Information
Data Trace® may also collect information identifying the industries in which our
clients work. We also collect any information a client chooses to divulge to us
when communicating with us through any of the options described in the “Contact
Us” section of the Websites.
III. Information Sharing.
We request information from you for our own legitimate business purposes and not
for the benefit of any nonaffiliated party. Therefore, we will not release your
PII to nonaffiliated parties unless: (1) the release is necessary in order for
us to provide the product or service you have requested of us; or (2) as
permitted by law. We may provide all of the types of PII listed above to one or
more of our affiliates. Such affiliates include financial service providers,
such as title insurers, property and casualty insurers, and trust and investment
advisory companies, or companies involved in real estate services, such as
appraisal companies, home warranty companies, and escrow companies. Furthermore,
we may also provide all the information we collect, as described above, to
companies that perform marketing services on our behalf, on behalf of our
affiliates, or to other financial institutions with whom we or our affiliates
have joint marketing agreements.
Mergers And Acquisitions
It is possible that Data Trace, its subsidiaries, affiliates, joint venture
companies, or any combination of them, could merge with or be acquired by
another legal entity. In such event, Data Trace may share PII collected from the
Websites with such other entity. Data Trace will notify such other entity of the
policy that applies to PII under Data Trace’s applicable privacy policy.
Other Information Sharing
In addition, we will also share information with third parties in response to a
subpoena or when we are required to do so by law, for example, in response to a
court order or other legal obligation; in response to a law enforcement agency’s
request; to protect the security or confidentiality of our records; or in
special cases when we have reason to believe that disclosing this information is
necessary to identify, contact, or bring legal action against someone who may be
causing injury to or interference with our rights. Users should also be aware
that courts of equity, such as U.S. Bankruptcy Courts, might have the authority
under certain circumstances to permit your PII to be shared or transferred to
third parties without your permission.
We may share aggregate information, which is not personally identifiable, with
others. This information may include usage and demographic data.
IV. Opt Out.
If you do not want Data Trace or our affiliates to contact you via email
regarding special offers or services that we think might interest you, you can
choose to discontinue such communication by informing us of your choice on our
opt-out page, by following the instructions included in our email or by
notifying us in writing at the address below.
If you do not want Data Trace to share your PII with third parties, you may
discontinue such sharing by informing us of your choice on our opt-out page or
by notifying us in writing at the address below.

Alternatively, you may inform us of your choice through our unsubscribe form. Submitting this form will remove you from all email marketing efforts.
Please note that we will endeavor to implement your opt-out requests within a
reasonable time, although for a time you may continue to receive mailings, etc.,
transmitted based on information released prior to the implementation of your
request. Please also note that even after such request is implemented, you will
continue to receive information directly related to the product or service for
which you registered (or which you otherwise agreed to receive), so you always
are kept informed.
Residents of California have additional privacy rights, which are described
further below.
V. Your California Privacy Rights.
If you are a California resident, you may request information regarding
disclosure of your PII to third parties for direct marketing purposes. To make

with “Data Trace Request for California Privacy Information” in the subject line
and in the body of your message. We will provide the requested information to
you at your e-mail address in response.
Please note we are required to respond to such a customer request only once
during the course of any one calendar year.
VI. Links To Other Websites.
The Websites may contain links to other websites. While we try to link only to
sites that share our high standards and respect for privacy, we are not
responsible for the content or the privacy practices employed by other sites.
Please note that when you click on one of these links you are moving to a new
website. We encourage you to read the privacy policies of those sites as their
privacy policies may differ from ours.
VII. Security of Information.
We use reasonable efforts to ensure that no unauthorized parties have access to
any of your PII. We currently utilize a variety of security measures to prevent
unauthorized access to our offices, computers, and electronic databases. Such
measures include encryption of Web-based communications, firewall filtering,
password protection, and the use of secure hardware and software. We currently
maintain reasonable physical, electronic, and procedural safeguards to guard
your PII.
We retain PII collected from our clients for only as long as reasonably
necessary to carry out the purposes for which the information was collected.
Once such information is no longer required, we take steps to ensure that the
information is destroyed in a reasonably secure manner.
VIII. Confidentiality of Information.
We believe that the PII you have provided to us should be kept confidential. We
restrict access to PII about you to those employees of Data Trace who need to
know that information to provide products or services to you. We use reasonable
efforts to train and oversee Data Trace employees to ensure that your
information will be handled responsibly and in accordance with this Privacy
Policy.
IX. Updating Your Information.
If a Website requires you to register to access or purchase products, you are
responsible for ensuring the accuracy of the information in your profile,

X. Changes in Policy.
Our privacy policy may change in the future. We encourage you to periodically
review this page to understand our policy regarding our collection and use of
PII. The effective date of this policy, as stated below, indicates the last time
this policy was revised or materially changed. Checking the effective date below
allows you to determine whether there have been changes since the last time you
reviewed the policy.
